Facts

Foster was charged with killing an old woman named Queen Madge White in 1986. During the trial, the prosecution excluded four qualified black jurors. Based on the Batson v. Kentucky case, the defense objected to the exclusion, which prompted the prosecution to explain and provide sufficient proof for their elimination (Oyez). The prosecution presented its reasons, which were accepted as satisfactory in the trial court. The all-white jury found Foster guilty of the murder and was subjected to a death penalty.
